EARTHWORKERS.COM USER PARTICIPATION AGREEMENT AND DISCLAIMER

Your use of any of the three internet sites housed on EARTHWORKERS.COM (Blue Grass Jack Russell Terrier Club, Earthworkers, Unlimited and Art Mart) confirms your acceptance in full of this participation agreement.

TERMS AND CONDITIONS of this Participation Agreement

You are visiting EARTHWORKERS.COM. Any person who wants to use this site must accept the terms and conditions of this Participation Agreement without change. The terms and conditions of this Participation Agreement may be changed by us in the future. If so, you will need to accept the new terms and conditions to continue using these services. In visiting EARTHWORKERS.COM, you use this site and its services at your own risk.

1. COMPLIANCE
As a user of this website, you agree to comply with all applicable laws, statutes and regulations regarding use of our services.

2. PRIVACY
The Art Mart Shopping program gathers some information so that Art Mart will have what is necessary to contact buyers for payment and shipment of items bought. Personal information is not sold or rented, can be used only for communication between Art Mart and buyers about Art Mart products and for no other purposes.

3. NO WARRANTIES
This website and services herein are provided on an "AS IS" basis. JACK RUSSELL CENTRAL.COM makes no other representations or warranties of any kind, express or implied, including and without limitation:

that the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement of this website or its services will meet your requirements;
that this website or its services will always be available, accessible, uninterruped, timely, secure or operate without error; that any implied warranty arising from course of dealing or usage of trade; and that any obligation, liability, right, claim or remedy in tort, whether or not arising from the negligence of EARTHWORKERS.COM. To the full extent permissible under applicable law, EARTHWORKERS.COM disclaims any and all such warranties.

4. GENERAL RELEASE
Because EARTHWORKERS.COM is not involved in transactions between Art Mart and buyers of Art Mart products, Art Mart buyers release EARTHWORKERS.COM (and its agents/employees) from claims, demands and damages, actual and consequential, of every kind, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

EARTHWORKERS.COM is not the agent of Art Mart, and we will not be involved in resolving any disputes between participants related to or arising out of any transaction. We urge Art Mart and its customers to cooperate with each other to resolve any such disputes. Before purchasing Art Mart products, Art Mart customers must read, understand and agree to abide by Art Mart guidelines and user agreements.

5. LIMITATION OF LIABILITY
EARTHWORKERS.COM will not be liable for any damages of any kind, including and without limitation, direct, indirect, incidental, punitive and consequential damages arising out of or in connection with the Participation Agreement, this website, its services, the inability to use the services or those resulting from any goods or services purchased or obtained or messages received or transactions entered into through the services.

6. INDEMNITY
You agree to indemnify and hold EARTHWORKERS.COM, its agents and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to your breach of this agreement or the documents it incorporates by reference, or due to your violation of any law or the rights of a third party.

7. APPLICABLE LAW
This website and its services are arranged, sponsored, or managed by EARTHWORKERS.COM in the state of Kentucky. The laws and regulations of Kentucky govern this Participation Agreement and all of its terms and conditions, without giving effect to any principles of conflicts of laws.

8. COPYRIGHT
All content on this site is the exclusive property of EARTHWORKERS.COM and protected by U. S. and international copyright laws. The content on this site may be used as an informational or as a shopping resource. Any other use, including the reproduction, modification, distribution, display or performance of the content on this site is strictly prohibited.

9. SITE SECURITY
Anyone attempting to compromise the safety, security, data integrity, service, or any other feature of EARTHWORKERS.COM will be suspended or terminated from using the site and may face legal action.

10. TERMINATION
EARTHWORKERS.COM retains the right to restrict access to EARTHWORKERS.COM website or its services or take any other action to restrict access to or availability of objectionable material.

EARTHWORKERS.COM, in its sole discretion, also may terminate this Participation Agreement, access to this website
or its services immediately without notice for any reason.

Your use of EARTHWORKERS.COM services confirms your acceptance in full of this Participation Agreement.
